In a construction project involving many parties, responsibilities and rights of the parties is clearly stated in the cooperation contract and clearly stated in the Vietnamese law, especially in Decree 37/2015/ND-CP.
Responsibilities of the General Contractor
The contractor must perform the binding responsibilities to ensure his rights and complete the contract signed with the investor.
The general contractor is both responsible for his workers, responsible for the bidding package, and responsible for the investor’s construction works.
Responsibilities to the workers
The general contractor is responsible for ensuring a safe working environment, suitable to the ability of employees; provide adequate protective equipment and pay wages on time to workers. In addition, the general contractor is also responsible for resolving conflicts that occur in the construction site.
Responsibilities to the construction work
Depending on the type of contract and terms in the contract, the construction unit has different responsibilities. The general consultant contractor is responsible for consulting works and is responsible for the legality and feasibility of the project. The general design contractor will have responsibilities related to the design and technical drawings for the entire project.
Responsibility for construction warranty
All works after construction and installation must have a warranty. The longer the warranty period, the more it shows the general contractor’s commitment to the quality of the work, and at the same time makes it easier for the investor to choose a quality general contractor.
The EPC general contractor will be responsible for the technological equipment provided for the project, including origin, material properties, and responsible for compensation if errors arise.
In addition, during the project implementation, the contractor is also responsible for checking the accuracy and completeness of the documents, specifications and technical descriptions provided by the Investor to the contractor.
